Web Hostly – Terms of Service

Welcome to Web Hostly! These Terms of Service (“Terms”) govern your access to and use of our web hosting services, websites, and related products (collectively, the “Services”). By signing up for or using any of our Services, you agree to be bound by these Terms.

 

1. Definitions

  • “Web Hostly”, “we”, “us”, or “our” refers to the legal entity operating the Services, registered in the UK.

  • “Client”, “you”, or “your” means the individual or entity using our Services.

  • “Account” means the billing and service access credentials associated with your use of Web Hostly.

  • “Content” refers to all data, information, or material uploaded, posted, or stored using our Services.

 

2. Eligibility

To use our Services, you must:

  • Be at least 18 years old.

  • Provide accurate, complete registration information.

  • Agree to comply with all applicable laws and regulations.

 

3. Services Provided

Web Hostly offers various services including but not limited to:

  • Shared Web Hosting

  • Reseller Hosting

  • VPS and Dedicated Hosting

  • Domain Registration and Management

  • SSL Certificates

  • Email Hosting

  • Business Website Development (Business Hub)

We reserve the right to modify, suspend, or discontinue any part of the Services with or without notice.

 

4. Account & Billing

  • You are responsible for maintaining the security of your account and all activities occurring under it.

  • All services are billed in advance, and your payment method must remain valid and up to date.

  • We may suspend or terminate your account for late or failed payments.

  • Certain services (e.g., domains or SSL) may auto-renew unless explicitly cancelled.

 

5. Acceptable Use Policy

You agree not to use our Services to:

  • Violate any laws or regulations.

  • Host or distribute malware, phishing content, or harmful code.

  • Send unsolicited emails (SPAM).

  • Infringe on intellectual property rights.

  • Upload or transmit obscene or offensive materials.

  • Abuse server resources or run abusive scripts/applications.

Web Hostly reserves the right to suspend or terminate any account found in violation.

 

6. Resource Usage

Clients on shared and reseller plans may not:

  • Use excessive server CPU, memory, or bandwidth beyond plan limits.

  • Run background daemons, bots, or cryptocurrency mining.

  • Use hosting as a file storage or backup system.

We may suspend accounts with abusive usage or request an upgrade to an appropriate plan.

 

7. Data Backups

  • Backups are provided as a courtesy on eligible plans (e.g., daily or weekly).

  • Web Hostly is not liable for any data loss; clients are encouraged to maintain their own backups.

 

8. Domain Registration

  • All domain registrations are subject to ICANN rules and registrars’ terms.

  • Domains may be auto-renewed unless cancelled prior to expiry.

  • It is the client’s responsibility to ensure timely renewals to avoid loss of domains.

 

9. Email Services

  • Outgoing email limits may apply to prevent spam.

  • We do not guarantee email deliverability due to third-party filters.

  • Email services should not be used for mass mailing without prior approval.

 

10. SSL Certificates

  • SSLs are provided via third-party partners (e.g., Sectigo, DigiCert).

  • Free SSLs may require renewal and revalidation.

  • Web Hostly is not liable for misissued, expired, or improperly installed certificates.

 

11. Website Design (Business Hub)

  • Basic websites are offered as a complimentary service with business hosting plans.

  • The design includes standard pages (e.g., Home, About, Contact) and does not include eCommerce, custom development, or branding.

  • Ownership of the website remains with the client; however, hosting must be maintained to retain access.

 

12. Support

  • 24/7 support is available through live chat, tickets, or email.

  • We aim to respond promptly but do not guarantee specific response times.

  • Certain support tiers may apply to advanced services.

 

13. Refund & Cancellation Policy

  • Web hosting services come with a 30-day money-back guarantee.

  • Domain registrations, SSLs, and third-party services are non-refundable.

  • Refunds are issued at our sole discretion and may be pro-rated.

  • To cancel, submit a cancellation request through your client area.

 

14. Termination

We may suspend or terminate your account if you:

  • Violate these Terms.

  • Fail to pay outstanding invoices.

  • Cause harm to our network, reputation, or other customers.

You may terminate your account at any time through the client area. No refunds will be issued for violations.

 

15. Limitation of Liability

Web Hostly shall not be liable for:

  • Loss of data, profits, or business due to downtime, delays, or service interruptions.

  • Actions of third-party registrars or software providers.

  • Unauthorized access to or alteration of your data.

Our total liability shall not exceed the amount paid for the Services in the prior 6 months.

 

16. Indemnification

You agree to indemnify and hold harmless Web Hostly and its employees, affiliates, and partners from any claims, liabilities, damages, or costs (including legal fees) arising from your use of our Services or violation of these Terms.

 

17. Modifications

We reserve the right to change these Terms at any time. Changes will be posted on our website and are effective immediately. Continued use of the Services indicates your acceptance of the revised Terms.

 

18. Governing Law

These Terms shall be governed by and construed under the laws of England and Wales. Any disputes shall be resolved exclusively in the courts of England.
